The Public Protector Busisiwe Mkhwebane suffered another blow on Monday as the North Gauteng High Court ruled in favour of the Public Enterprises Minister Pravin Gordhan. Gordhan had made an application temporarily interdicting the implementation of Mkhwebane’s remedial orders while he takes her report on judicial review.
The Public Protector ordered President Cyril Ramaphosa to discipline Gordhan within 30 days.
In the judgment delivered, Judge Sulet Potterill said: “Much of the orders are vague, contradictory and/or nonsensical.”
Mkhwebane’s report found Gordhan to be guilty of maladministration for his role in establishing an intelligence-gathering unit while he was SARS commissioner.
Another finding by Mkhebane was that Gordhan lied to parliament that he had never met the Guptas, thereby violating the Executive Members Ethics Act.
